Judge Louis Kaplan Did Not Like The Chevron Litigation From Day One and Just Expressed His Reasons In A 500 Page Opinion!!

At least in the  US  for now, enforcement of the  Ecuadorian's judgment  against Chevron is temporarily on hold. Judge Kaplan  opined in no uncertain terms that  the judgment of $19 billion in Ecuador  was facilitated by fraud, bribes and criminal activity. The case will obviously travel the Appellate route now.  Lead  plaintiffs' counsel could be facing some additional legal headaches of his own.
  So while the plaintiffs  still have some jurisdictions  in which they can attempt to enforce their judgment(i.e. Canada), their options are now very, very much limited.
  Chevron  has to be feeling pretty good today about this turn of events.

And of course life goes on for the  Ecuadorians.

Chevron Case; Second Circuit Puts Their Foot Down, Say Sayonara to Judge Kaplan's Global Injunction On Enforcing $18 Billion Judgment in Ecuador.

The Second Circuit Federal Court of Appeals in Manhattan didn't take long. Just three days after hearing oral argument on Judge Kaplan's "global injunction " relating to enforcement of the Ecuador judgment against Chevron, a three judge panel vacated the injunction and effectively cancelled the November trial before Judge Kaplan.
With the injunction vacated plaintiffs would be free to enforce the judment. But James Tyrell, plaintiff's lead appellate counsel promised the "Second Circuit " that plaintiffs would await enforcement until an intermediate appellate court in Ecuador has reviewed the judgment.
For now, " Oz has spoken " !

Chevron Case Revisited; Second Circuit Panel Sends a Message.

As you may recall Judge Lewis A. Kaplan of the Southern District of New York previously issued a injunction barring worldwide enforcement of a multi-billion dollar judgment obtained against Chevron in Ecuador. Plaintiff appealed and a three Judge Panel from the Second Circuit Court of Appeals just issued an interim decision staying that part of Judge Kaplan's injunction which bars enforcement(plaintiffs can seek to enforce) but kept in place that part of the injunction which enjoins the raising of funds to mount an enforcement action.
My opinion; Huge victory for plaintiffs, huge blow to defendant Chevron!
I believe the Panel is sending a message to the litigants...The message being, maybe the US Courts will not get involved in each and every international dispute.
